1. Overview

This Refund Policy applies to all purchases made through **aigain.pro** and via the **Whop** platform from:

We stand behind the quality of our services and digital products. This Policy explains when and how refunds are available, what process to follow, and your rights as a customer under EU and Polish consumer protection law.

2. Product & Service Categories

Our offerings fall into four categories, each with its own refund terms:

3. Digital Products (Purchased via Whop)

### 3.1 General Rule

Due to the instant-delivery nature of digital products, **all sales are final** once the product has been accessed or downloaded.

### 3.2 EU Right of Withdrawal (14-Day Cooling-Off Period)

If you are a **consumer** (non-business) residing in the **European Union**, you have the right to withdraw from a digital product purchase within **14 days** of the purchase date — **provided you have not yet accessed or downloaded the product**.

By accessing or downloading the digital product, you **explicitly consent to the immediate performance** of the contract and **acknowledge that you waive your right of withdrawal** under Article 16(m) of EU Directive 2011/83/EU.

We include a clear notice of this waiver at checkout.

### 3.3 Eligible Refund Situations for Digital Products

Regardless of the above, we will issue a refund if:

  • The product is **materially different** from what was described at the time of purchase
  • The product contains **significant technical errors** that render it unusable, and we are unable to provide a fix within **7 business days** of a reported issue
  • You were **charged incorrectly** (duplicate charge, wrong amount)
  • The purchase was made **fraudulently** (unauthorized transaction)
  • ### 3.4 Non-Refundable Situations

    Refunds will **not** be issued for:

  • Change of mind after accessing the product
  • Failure to read the product description before purchase
  • Lack of technical skill to use the product (we offer support — see Section 7)
  • Dissatisfaction based on unrealistic expectations not supported by our published materials
  • Violation of our Terms of Use

    4. Subscriptions (Whop)

    ### 4.1 Cancellation

    You may cancel your subscription at any time through your Whop account settings. Cancellation takes effect at the **end of the current billing period**. You retain access to the subscription content until that date.

    ### 4.2 Refunds on Subscriptions

  • **Monthly subscriptions:** No partial refunds are provided for unused days within the current billing period
  • **Annual subscriptions:** If you cancel within **14 days** of your initial annual purchase and have not accessed more than 20% of the content, you may request a **pro-rated refund** for the unused full months
  • **First-month guarantee:** If you are dissatisfied with your first month of a new subscription and have not accessed more than 30% of the content, contact us within **7 days of purchase** for a full refund
  • ### 4.3 Price Changes

    If we increase subscription prices, we will provide at least **30 days' notice** before the change takes effect. You may cancel before the new price applies without penalty.

    5. Custom Development Services

    ### 5.1 Before Work Begins (Pre-Development)

    If you cancel a project **before any work has commenced**, we will refund **100% of any advance payment** within 5 business days.

    ### 5.2 After Work Has Commenced

    Once development work has started:

  • Cancellations within the **first 25% of the project timeline**: refund of advance payment minus the value of work completed (calculated at our standard hourly rate)
  • Cancellations after **25% of the project timeline**: no refund of the deposit; any unbilled work up to the cancellation date may be invoiced
  • ### 5.3 Project Disputes

    If you are dissatisfied with a deliverable, you must:

    1. Submit detailed written feedback within **7 business days** of delivery

    2. Allow us a **reasonable revision period** (typically 5–10 business days depending on scope) to address the issues

    We will make up to **2 rounds of revisions** at no additional charge for deliverables that do not meet the agreed specification. Refunds for completed and accepted deliverables are not available.

    ### 5.4 Force Majeure

    We are not liable for delays or failures caused by circumstances beyond our reasonable control (power outages, API provider failures, third-party platform downtime). In such cases, we will complete the work as soon as reasonably practicable.

    6. Consulting & Strategy Sessions

    ### 6.1 Cancellation Before Session

  • Cancelled **more than 48 hours** before the scheduled session: **full refund**
  • Cancelled **24–48 hours** before: **50% refund** or option to reschedule
  • Cancelled **less than 24 hours** before or no-show: **no refund**
  • ### 6.2 After Session Delivery

    Consulting and strategy sessions are delivered in real time. Refunds are not available after a session has been completed. If you experience a technical issue that prevents full delivery, contact us and we will arrange a follow-up session at no charge.

    7. How to Request a Refund

    To submit a refund request:

    1. **Email us** at **info@avita-pl.pl** with the subject line: `Refund Request – [Order ID or Product Name]`

    2. Include in your email:

  • Your full name and registered email address
  • Order ID or Whop transaction reference
  • Date of purchase
  • Product or service purchased
  • Reason for refund request
  • Any supporting evidence (screenshots, error messages, etc.)
  • 3. We will acknowledge your request within **2 business days**

    4. We will review and respond with a decision within **7 business days**

    8. Refund Processing

    Approved refunds will be processed using the **original payment method** within **5–10 business days** after approval (processing times may vary depending on your bank or payment provider).

    Refunds are issued in the **same currency** as the original transaction.

    9. Chargebacks

    We strongly encourage you to contact us before initiating a chargeback with your bank. Unauthorized or fraudulent chargebacks may result in:

  • Immediate suspension of your account and access to purchased products
  • Reporting to Whop's anti-fraud systems
  • Legal action to recover costs associated with the chargeback dispute
  • We take chargeback fraud seriously and cooperate fully with payment processors to contest illegitimate claims.

    10. EU Consumer Rights

    If you are an EU consumer, this Policy does not limit your statutory rights under:

  • **EU Consumer Rights Directive** (2011/83/EU)
  • **Polish Consumer Protection Act** (Ustawa o prawach konsumenta)
